Alimony

Family Law - Alimony

Definition:

Alimony is money paid by one spouse to the other after divorce, so that he/she will be able to maintain the standard of living that they experienced during the marriage. Alimony is awarded while the action of divorce is pending and is based on need, taking into consideration how long the marriage lasted, and the ability of the spouse to pay accordingly. For example, a long term marriage where one spouse was fully dependent on the other spouse will most likely be awarded permanent spousal support.

Consequences of Alimony:

Going through a divorce can be a stressful and expensive process. Alimony or spousal support is typically awarded when one spouse has a much higher income than the other spouse. In some states such as New Jersey, there are no established laws for the allocation of spousal support, leaving the amount of alimony up to the discretion of family court judges.

What a Lawyer can do for you:

An alimony lawyer represent clients in alimony matters, especially during divorce or dissolution of marriage. An alimony lawyer can help petition the court if the amount of alimony has been altered. A lawyer can establish your case for alimony by presenting the length of your marriage, the standard of living you had during the marriage and your contributions to the marriage.
