Dram Shop
Definition:
Dram shop refers to the law that governs the liability
of taverns, liquor stores and other commercial establishments that serve
alcoholic beverages to customers. Dram shop laws
apply to those establishments who sell alcohol to visibly intoxicated
persons or minors, who then cause death or injury to third-parties. Dram
shop laws prohibit establishments to:
- Selling liquor to visibly intoxicated customers
- Selling liquor after hours
- Selling liquor to minors
- Selling liquor without a license
Consequences of Dram Shop:
Dram shop liability laws vary state to state. Under dram shop law, plaintiffs with a valid case can recover damages when they demonstrate a proof of sale of alcohol to the patron, injuries sustained by the patron, a cause between the alcohol sale and intoxication and that intoxication was a cause of damages to a third party. What a Lawyer can do for you:
