Employment Law - Arbitration

Pregnancy Disability Leave:

Women that are disabled during pregnancy are entitled to take a pregnancy disability leave. The Pregnancy Disability Leave Act gives women the right to take up to 16 weeks of leave for pregnancy and childbirth. Employees are entitled to leave work in situtations that involve morning sickness, pre-natal care, bed rest and post-birth (child bonding) time.

Consequences of Pregnancy Disability Leave:

Under the Pregnancy Disability Leave Act, employers must provide disability leave for woment that are disabled by pregnancy or childbirth. The leave could be taken a little bit at a time, or all at once before or after childbirth. The law prohibits employers to terminate, refuse to promote or discriminate against a female employee in any way. Keep in mind, however, that employers have the right to get advance notice for foreseeable pregnancy disability leave.

If you have been discriminated against by your employer for pregnancy disability leave, an employment lawyer can help.
