Trainee Visas

Immigration Law - Trainee Visas

Definition:

The trainee visa (H-3 visa) is a non-immigrant visa that allows foreigners to attend a paid traineeship in the U.S. The trainee visa is typically applied for by individuals who were invited to join in a training program that was offered by a U.S branch of their own company or by another U.S company. The applicant must show that he/she does not have the same opportunity for training in their home country.

Consequences of Trainee Visas:

The employer who sponsors the trainee visa must show that the training is not offered in the applicant's home country and that the applicant will not be employed at that company. The trainee visa is not for graduate education or medical training and it must be proven that the trainee is currently employed in their home country.

What a Lawyer can do for you:

Obtaining a trainee visa may require paperwork and careful preparation. An immigration lawyer can take the time to understand your needs to make sure your trainee visa is handled properly. It is recommended to consult with an immigration lawyer so that the application runs smoothly and the possibility of denial is avoided.
